Who you are contracting with

This website and store are operated by Tymon Healthcare Private Limited, a company incorporated in India and registered at B-XXX, 2185/C-2, Opp. Petrol Pump, Sua Road, Vill. Gobindgarh, Ludhiana, Punjab – 141017, India, trading as Darakhtveda (“we”, “us”, “our”). “You” means anyone who accesses the site or places an order through it.

By using this site you agree to these terms, our Privacy Policy, our Cookie Policy, our Shipping & Delivery policy and our Returns & Refunds policy, all of which form part of this agreement. If you do not agree with them, please do not use the site.

Eligibility

You must be at least 18 years old and legally capable of entering into a contract under the Indian Contract Act, 1872 to place an order. If you are under 18 you may use the site only with the involvement of a parent or guardian, who takes responsibility for the order.

We currently sell and ship within India only.

Your account

You may buy as a guest; an account is optional. If you create one, keep your password to yourself and tell us promptly if you think someone else has used it. You are responsible for activity under your account. We may suspend or close an account that is being used fraudulently or in breach of these terms.

Products, descriptions and claims

The products sold here are Ayurvedic preparations manufactured in India under applicable licences. Product descriptions, ingredient lists and images are provided in good faith and are as accurate as we can make them. Colours may render differently on different screens, and packaging may be updated from time to time.

The claims we make for a product are the claims carried on its approved label and nothing more. See the disclaimer below.

Product and health disclaimer

The products sold here are Ayurvedic preparations manufactured in India under applicable licences. The claims made for any product are the claims carried on its own approved label, and nothing on this website is intended to state or imply anything beyond them. Route of administration, dosage, warnings and shelf life differ from product to product and are printed on each pack. Always read the label and follow the directions on the pack.

Nothing on this website is medical advice, and nothing here diagnoses, treats, cures or prevents any disease. It is not a substitute for consultation with a registered medical practitioner or a qualified Ayurvedic physician, and it is not a substitute for any medicine you have been prescribed. Consult a qualified practitioner before use, particularly if you are pregnant, nursing, taking medication, or managing a diagnosed condition. Discontinue use and seek medical attention if any adverse reaction occurs.

Keep out of reach of children. Do not use any product after the expiry date printed on its pack, and observe the after-opening period stated on that pack where one is given.

Price, taxes and country of origin

Prices are in Indian Rupees and are inclusive of GST unless stated otherwise at checkout. The total payable, including any shipping charge, is shown before you confirm the order and nothing is added afterwards. Net quantity, retail sale price, month and year of manufacture, expiry and country of origin are declared on the pack in accordance with the Legal Metrology (Packaged Commodities) Rules, 2011.

Country of origin: India.

We may change prices at any time, but a change never affects an order we have already accepted. If a product is listed at an obviously incorrect price because of a technical or human error, we may cancel the order and refund you in full rather than fulfil it; we will tell you as soon as we know.

Orders and acceptance

Your order is an offer to buy. A contract comes into existence only when we dispatch the goods, or when we send you a message confirming dispatch, whichever is earlier. Until then we may decline or cancel an order — for example if the item is out of stock, if we cannot deliver to your pin code, if payment is not authorised, or if we reasonably suspect fraud or a resale operation. If we cancel, you are refunded in full.

We may limit the quantity available to one buyer.

Payment

Payment is taken at checkout through third-party gateways. We do not see or store your card details. You confirm that the payment method you use is yours or that you have permission to use it. If a payment is reversed or charged back without cause, we may suspend the account and recover the amount owed.

Delivery, returns and cancellation

Delivery timelines, charges and tracking are set out in Shipping & Delivery. Replacements, cancellations and the limited circumstances in which we refund are set out in Returns & Refunds. Please read that page before you buy: these are sealed preparations intended to be applied to the body or taken internally, and we do not accept change-of-mind returns.

Risk in the goods passes to you on delivery. Title passes when we have received payment in full.

Acceptable use

You agree not to use this site to break the law; not to attempt to gain unauthorised access to it or to any account; not to introduce malicious code; not to scrape, mirror or systematically extract its content; not to resell our products without our written agreement; and not to post or send anything defamatory, obscene, infringing or misleading.

Intellectual property

The text, photographs, illustrations, page designs, source code and the Darakhtveda name and marks on this site belong to us or are used with permission, and are protected by Indian copyright and trade mark law. You may read, print and share pages for your own non-commercial use. You may not copy our copy, our layouts or our photographs for a competing product, and you may not use our name or marks without written permission.

If you send us feedback, a review or a suggestion, you allow us to use it without obligation or payment, and we will not publish your full name without asking you first.

Third-party links

Where we link to a site we do not control, we are not responsible for its content, its products or its practices, and a link is not an endorsement.

Disclaimer of warranties

The site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, error-free, or free of harmful components, and we may suspend it for maintenance. To the extent permitted by law, we exclude implied warranties — but nothing in these terms excludes or limits the rights you have under the Consumer Protection Act, 2019 or any other law that cannot be excluded by agreement.

Limitation of liability

To the maximum extent permitted by law, our total liability to you in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, loss of profit, or loss of data.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the site.

Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control — including natural disaster, epidemic, strike, civil unrest, government action, carrier failure, power or telecommunications failure. We will tell you and, where delivery becomes impossible, refund you.

Governing law and jurisdiction

These terms are governed by the laws of India. Subject to the consumer's statutory right to approach the appropriate consumer forum where they reside, the courts at Ludhiana, Punjab have exclusive jurisdiction over any dispute arising out of them.

Complaints and dispute resolution

Please write to our Grievance Officer first — most things are resolved in a single reply. Nothing in this clause prevents you from approaching a consumer forum or any other authority under the Consumer Protection Act, 2019.

General

If any provision of these terms is held unenforceable, the rest stands. Our failure to enforce a provision is not a waiver of it. These terms, together with the policies referred to in them, are the whole agreement between us. You may not assign your rights under them; we may assign ours to a successor in our business.

Changes

We may amend these terms. The version published on this page when you place an order is the version that governs it.

We acknowledge every complaint within 48 hours of receiving it and issue a complaint reference number with that acknowledgement. We resolve complaints within one month of receipt. If a complaint will take longer than that, we will tell you why and give you a date.
